Carlisle Lavender Farm and Focus On Love Foundation
Waiver, Release & Indemnification Agreement
This agreement is entered into with Carlisle Lavender Farm and Focus On Love Foundation (The Organizations) and the registering Participant, or in the case of registering a participating minor, the registering parent or legal guardian is the Participant (The Participant). To permit The Participant to participate in on-farm activities. This agreement is for the benefit of the Organizations and each of their staff members, employees, officers, directors, agents, volunteers, and representative (known individually as “indemnity” and collectively as “indemnities”).
The Participant has been advised that the activity of working in and around nature including an active lavender plant and wildflower farm may have hazards. Bee's pollenate plants and can behave unpredictably and may react by stinging when approached, startled, or provoked. As such The Organizations cannot be held liable for injuries or accidents that may occur as a result of working within nature in around the lavender/wildflower farm. Participants understand that the following are some, but not all, of the risks associated with working with and around outdoors and an active lavender/wildflower farm.
- Being bit or stinging by bees and other insects
- Severe allergic reactions to insect bites
- Slips/trips/falls indoors or outdoors
- Loss of and/or damage to personal property
- Damage to vehicles parked on Carlisle Lavender Farm property
The Participant is aware that injuries, loss of or damage to personal property, and possibly death may occur as a result of participation at Carlisle Lavender Farm and Focus On Love Foundation events. The Participant agrees that the Organizations and their indemnities shall not be held responsible nor liable for any personal or other injury including death, damage, loss, or expense to The Participant or their property, whether such injury, death, damage, loss or expense is cause by negligence of The Organizations, any indemnities, or a third party.
The Participant and their heirs, executors, parent(s), legal guardian(s), and administrators agree to hold harmless each indemnity against all manner of legal actions, such as suits, debts, claims or liability of any kind incurred while The Participant participates at Carlisle Lavender Farm and The Organizations events.
The Participants fully, completely, and unconditionally waive and release each indemnity from all rights, liabilities, duties, claims, charges, demands, actions, damages, costs, attorney fees, or expenses of any kind that The Participants may have now or in the future against The Organizations or any indemnities relating to participation at Carlisle Lavender Farm activities or events.
The Participant fully represents and warrant that they are physically and mentally fit to safely photograph nature in and around the farm. Should an accident or other medical emergency occur while participating on Carlisle Lavender Farm property or while The Participant is en route to or from The Organizations sponsored events, and staff members are unable to timely reach Emergency Contact for medical authorizations, then The Participant hereby gives consent for The Organizations staff members to authorize medical treatment.
The Participant represents and warrants that The Participant has current medical insurance coverage and agrees to be responsible for all billings and debts incurred with respect to such medical treatment or services.
The Participant and/or parent or legal guardian represents and warrants that they have the authority to enter into this Agreement have not been forced nor coerced to enter into this Agreement.
The Participant further authorizes the Focus On Love Foundation and Carlisle Lavender Farm to use photographs taken during event for non-profit promotional or program funding purposes.
If any provision of the Agreement is found to be unenforceable in any way, it shall be enforced to the maximum extent possible and all other provisions of this Agreement shall remain in full force and effect.
